War On Iran: – ‘New’ Iran Demands Repeat MoU Conditions

U.S. media claim that Iran has set out new conditions to solve the conflict with the U.S. But the new text it has published is just a repetition of  clauses the U.S. had already signed on to.

On Saturday Iran published ‘new’ demands for the reopening of the Strait of Hormuz:

[Secretary of Iran’s Supreme National Security Council Mohammad Baqer Zolqadr] said the US should observe the six following conditions:

“1. Never, and in no language, threaten Iran or insult the sanctities of this nation.

2. Permanently end the war and aggression against Iran and Iran’s allies in Lebanon, Palestine, Yemen and Iraq.

3. Lift the naval blockade and withdraw its military forces (naval and air) from around Iran.

4. Pay in full, without any reduction, the damages caused to Iran by the two wars of aggression and imposition.

5. Lift the unjust and illegal sanctions against the Iranian nation.

6. Unconditionally release the blocked and stolen assets of the Iranian people.”

These demands seem to have confused U.S. observers. The Wall Street Journal claimed (archived) that these were somehow more harsh than those which had been previously issued:

[..] Iran insisted Saturday on its highest price yet for permitting the free flow of traffic in the waterway, seeking billions of dollars in U.S. payments, the removal of American troops from the region and an end of the U.S. naval blockade, among other things.

“Iran’s recent hardline demands for reopening the strait make it increasingly difficult for the president to manufacture a face-saving off-ramp from the conflict,” said Mona Yacoubian, director of the Middle East program at the Center for Strategic and International Studies, a Washington think tank.

The WSJ author and his ‘expert’ are mistaken. There is nothing new in the Iranian demands. They are direct repetitions of clauses laid down in Memorandum of Understanding which the White House had negotiated and President Trump had publicly signed.

Point 1 of the MoU notes that the parties “undertake .. to refrain from the threat or use of force against each other” which is similar to point 1 of the ‘new’ conditions.

Point 1 of the MoU also had the parties “declare the immediate and permanent termination of military operations on all fronts, including in Lebanon, …”. This is repeated, and spelled out in more detail, in point 2 of the new conditions.

Point 3 of the ‘new’ demands, the lifting of the blockade and withdrawal of U.S. forces, is equal to point 4 of the MoU:

.., the United States of America will begin the removal of its naval blockade and any disturbances or impediments against the Islamic Republic of Iran, and will fully end the naval blockade within 30 days. … The United States of America further undertakes to remove its forces from the proximity of the Islamic Republic of Iran within 30 days after the final deal.

Even Point 4 of the ‘new’ version, the demand for reparations, was already included in the MoU:

The United States of America undertakes with regional partners to develop a definitive, mutually agreed plan with at least USD 300 billion for the reconstruction and economic development of the Islamic Republic of Iran.

Likewise, point 5 and 6 of the ‘new’ demands are shorter repetitions of points 10 and 11 of the Trump signed MoU.

The differences between Iran’s newly published demands and the MoU are references in the later one to nuclear issues.

The U.S. had demanded to include those into the MoU and there is simply no point for Iran to include these U.S. conditions into its most recent version.

The only real difference between the MoU and the new conditions is the timing. The MoU set out to undertake the measures step by step along a defined timeline with each side responding to the others side’s fulfillment of previous clauses.

It was the U.S. which did not stick to the MoU but immediately breached its promises. As soon as he had signed the MoU Trump was back at threatening Iran thus breaking its point 1 condition. The U.S. then arranged for a separate agreement which extended Israel’s war and occupation of Lebanon instead of ending the war under the MoU’s conditions. It ignored Iran’s privilege under the MoU to “make arrangements using its best efforts for the safe passage of commercial vessels” through the Strait of Hormuz by making separate arrangements with Oman.

The U.S. has demonstrated that it can not be trusted. No one can assumed that it will stick to any conditions of previous or new agreements at least when it comes to phased commitment. The U.S. is not trustworthy and will thus get no upfront credit.

That is why Iran is demanding the upfront fulfillment of any promise the U.S. has made. Only when those are fulfilled will Iran move to act on its own commitments.

Trump can easily solve the conflict around the Strait of Hormuz. He simply has to fulfill the commitments set out in the MoU he had already agreed to. He may not like that he will now have to do that upfront but that is just an obvious consequence of his own mistake of not sticking to it in the first place.

The only clause where Trump has real limits is the payment of reparations to Iran for the war damage the 20,000 or so U.S. strikes have caused. Trump would need Congressional agreement to pay out that money.

But the compromise here is obvious and simple. If the U.S. officially agrees that Iran can take tolls from ships crossing the Strait this could be seen as a payment in kind.

This might seem unfair to other countries which would have to pay the tolls but it is a reminder for them to become more active when the U.S. needs to be reigned in.

If there’s no way the US will agree to pay reparations (and I see no chance of that), Iran is better off eventually dropping the demand from the negotiations so that the issue will remain a live and outstanding grievance Iran always can cite.

How would the US “officially agreeing” to recognize Iran’s sovereign right be an adequate substitute for reparations, which is a completely different matter? If there’s no way the US will agree to pay reparations (and I see no chance of that), Iran is better off eventually dropping the demand from the negotiations so that the issue will remain a live and outstanding grievance Iran always can cite.

I wouldn’t doubt the con artistry of Trump, just that he seems, whether willingly, by 4D chess, or not, to have done a fine job so far with alienating in different ways, many places, including those of my own residence here in so-called Canada, and more or less removing the US– at least if Iran and/or a crashing US economy have their way– from West Asia/Middle East, at least from a military standpoint.

The Trump administration never had the political capital to fulfill the demands of the MOU in the first place, but Trump signed it anyway because they needed to release the economic pressure of high oil prices.
 
It worked! While Trump wasn’t able to trick Iran into giving up control of the Straits, Bessent figured out how to better manipulate the oil markets. While the physical situation for oil is much worse than it was two months ago, oil prices are some $20 lower.
 
Now, judging by Bessent’s comments, it looks like the U.S. is settling into this ‘War of Economic Attrition’ for the long haul. According to Bessent, they will be able to bypass the Straits of Hormuz, within two years, by building oil pipelines.
(10 million bbls/day within two years seems a bit of a stretch to me!)

I’ve stated before that the US never had any intention of honouring the MoU. I still hold this view. Bullies don’t stand down – they have to be put down.
 
Domestic, economic and logistical factors are forcing a pause in active kinetics from the Hegemon – post mid-terms [assuming the AI bubble has not burst by then] POTUS’ malignant narcissistic oversized ego will demand further kinetics, however futile – meanwhile economic and other asymmetric pressures on the Islamic Republic will continue. Yes I know I left out Italy and France and Austria-Hungary. The point is that the rise of the communists in China is a direct result of Western interference in Chinese internal affairs with obvious parallels to Iran. And the stupidity of the West, its sheer hubris, is what most sticks out.
The rapaciousness of the Western forces plus Japan was notable and exactly like today. A interesting tidbit, the gold plating on the copper tanks in front of the Forbidden City palaces was scraped off by allied troops, leaving scratch marks that can be seen today. The ludicrous figures about how many people were killed or died of famine in China under Mao, are fully the result of western imagination. Any attempt I have seen are based on taking years with very high birthrates, extrapolating these to difficult times as if they would not be effected by periods of austerity and civil strife, then saying: there should have been so and so many people in later year x, but there are less, therefore the difference must have been killed or starved.
Note that even during the hungry years of “The Great Leap Forward” at the end of the fifties – mainly caused by extreme weather circumstances – the life expectancy of Chinese people decreased just to the level that it ALWAYS had in India under British colonialism.
But of course – let us just suppose that all people that died prematurely due to hunger in China should be put on the account of the Chinese Communist Party. The to be fair all premature death’s in Africa, Latin-America, and large parts of Asia should be put on the account of  western imperialism, making the victims of western imperialism to count in billions.

That is no business of US, is tripartite Iran, Oman and ultimately UN representing international concerns (currently without agency in the arrangement due to customary law not being replaceable by UNCLOS due to non ratification by Iran) .

The closure of the strait by Iran is retaliatory due to war on it by US, so restricting hostile traffic.

Charging fees is a unilateral decision by Iran currently, under that circumstance.

If freedom of transit is returned, fees/no fees will be as decided and arranged between Iran and Oman, and hypothetically the UN.

No US in that, apart from removing conditions that have Iran restrict transit of the strait, or eventually as part of UN position.

Why should he, if the goal of his handlers is keep the straits closed in order to trigger “woldwide” (whatever this might mean) economic depression and collapse, famines and to prepare the ground for cancelling the old and upsetting a new financial system?
 
The only reason for not ending the war which makes sense is that the consequences of the prolonged blockade have been from the beginning or have become in the meantime the true goals of the US American war of aggression.

Bessent and his boss can say whatever they want … as most here know, the US is agreement incapable, so it’s what they do that matters, not what they say. 
If they start closing bases and consolidating into Israel and offshore sites, if they quietly stop the blockade, if money from various sources starts flowing to Iran, then things are headed in the right direction.

The problem with complying with the MoU.. now versus doing so at the time the MOA was agreed creditability.  A lot of entities (nations, corporations and individuals) will realize the fallacy in buying military equipment from manufacturers who cannot show its produced equipment can win wars.

As things stand now, the government gives the military contractors what it cost the contractor to make the equipment so the contractor has no un reimbursed cost of goods sold and there is only one contractor making the particular equipment.

What needs to happen is to reverse the process.. The contractor must produce the equipment into finished goods inventory with its own funds ( in this way many firms can compete for the military business and the government is not absorbing the cost of corruption but is instead benefiting from being able to select products that meet the need).

  In the reversed scenario: the entities that make the stuff and put it in finished goods inventory, and then try to sell their finished goods to the government.  Hence government would have an array of finished goods designed to meet defined wartime needs to select from.  IOWs the government buys like everyone else.. from finished goods inventories.  Government does not pay to create the FGIs and government has no risk of loss if the company’s product fails to attract a government buyer.  After all competition is what capitalism is all about.
