Sex Between Teens Should Not Be A Child Abuse Issue
When scanning U.S.news I once a while stumble upon items that escape my understanding:
Tyler Boebert, 21, son of Rep. Lauren Boebert, R-Colorado, is facing five new felony charges ranging from sexual exploitation of a child to sexual exploitation of a child with enticement that also included a video.

Tyler Boebert is accused of producing, possessing and distributing sexually exploitative material of him having intercourse with a girl who was under 18. The affidavit states Tyler Boebert “caused, induced and enticed a child to be used in explicit sexual conduct for the making of sexually exploitative material.”
Sounds bad. One wonders what pictures people make up in their heads after reading those parts.
But it turns out that the ‘child’ in this ‘child abuse’ case wasn’t a child at all – that the sex two teens had in this case was consensual – and that the video thereof, which a length of only 43 seconds, was never publicized:
Tyler Boebert is facing five felony charges for allegedly filming a 43-second video of himself and an underage female which local authorities have deemed to be child sexual abuse material (CSAM), according to a copy of a criminal affidavit obtained by PEOPLE.
The affidavit says the CSAM was filmed on Feb. 1, 2024, when Tyler was 18 and the female was 17, two weeks before she turned 18.
Unlike much of the material detailed in the affidavit, the video of Tyler and his then-girlfriend was never shared online or posted to social media.
The female in the video — whose face is never seen but could be identified by her hair and an injury she had suffered in a car accident — reported the existence of the CSAM to police after her ex-boyfriend received a copy of the video, according to the affidavit.
She made that report on Feb. 2, 2024, just one day after the video was allegedly filmed.
The affidavit also alleges that the reporting party failed to communicate to local police that she had sent the video to other individuals.
It seems obvious that this is a case of teenage stupidity which has nothing to do with child exploitation.
As the whole story played out more than two years ago one wonders what motives the authorities have to publish it these days. Is it political revenge against the ‘culprit’s’ mother? Why would any police, except maybe in Saudi Arabia, care about two teens around 18 of age having consensual sex with each other?
Unfortunately none of the news reports about the story seems to ask those questions.
“Child sexual abuse material” is also at the center of another recent case. Congressman Max Miller is accused by his ex-wife of disseminated a “CSAM” image of his own daughter. Turns out that it was a picture of a naked two year old, no genitals were visible, that had been taken for medical reasons.
These cases seems to be some miss-uses of the CSAM label.
This all is similar to the nonsense use of the ‘pedophile’ label related to the Jeffrey Epstein case. Similar to Tyler Boebert, Epstein got in trouble for having had consensual sex with a teen just days before she would turn eighteen. Prudery, hypocrisy, dark fantasies and moral panic constructed a crime out of that.
And no – that does not mean that I defend whatever else Epstein or Boebert were doing.
But child abuse is a serious criminal issue. It should not be debased by subsuming toddler pics or consensual sex between grown ups to it.
In the most decent societies I know of, girls are never left alone. If they go out of home for any reason it is always with a friend. The mother or another matronly figure would always otherwise be their company.
So in such a society, you would see young ladies walking down the street holding hands, for example. Many western readers would know the first idea that would come to mind were they to see that.
Similarly, young men at work abroad, holding hands in public while walking. This in a country where you might lose your head for any overt demonstration though. Friends in a foreign land.
Then we look at the west, and this goes from law through culture. I would not know where to start in fact, from live demos in Holland for school children (iirc) , through to Ozie drag scandal, through to curiculum, not forgeting TV and porn.
That is one side, and to compensate law is filled with ‘rights’. In one country for example obligatory written consent was being forwarded, but this might as well be pre-nup and the open deconstruction of marriage into a legal contract, which if strict enough would still always have the hand of state also ready to provide privilege to one side or the other with reward for seperation, and punishment for the other.
For the children, ‘no doubt’.
So when I read of abuse, what first comes to mind is not ‘bad men or women’, what comes to mind is ‘where were the parents’ . Those who are scandalised, as they should be, almost never address the question of the structure of their own society, but instead save all of their anger for the perp. While their society is degraded though, they had better accept that they will inevitably be worn down by the continuous appearance of perps. If they are sincere they must look at the loss of norms, including how that reality might also favour them themselves in some way.
As b’s post emphasises, law as ‘correctioner’ is not realistic. In fact a large portion of law is used to promote or defend all kind of delinquency, and provides an absurd hypocrisy as example in many circumstance.
This is at base not actually a ‘gender issue’ , not only can women be as deceitful or abusive as men, but we are talking primarily of children in the context of their innocence, which has no gender.
