ICC Prosecutor Asks For Arrest Warrants For Netanyahoo, Gallant And Others

Today the prosecutor of the International Criminal Court, Karim A.A. Khan KC, has filed applications for warrants of arrest before a pre-trial chamber of the court.

These concern both sides of the conflict in Palestine:

On the basis of evidence collected and examined by my Office, I have reasonable grounds to believe that Yahya SINWAR (Head of the Islamic Resistance Movement (“Hamas”) in the Gaza Strip), Mohammed Diab Ibrahim AL-MASRI, more commonly known as DEIF (Commander-in-Chief of the military wing of Hamas, known as the Al-Qassam Brigades), and Ismail HANIYEH (Head of Hamas Political Bureau) bear criminal responsibility for the following war crimes and crimes against humanity committed on the territory of Israel and the State of Palestine (in the Gaza strip) from at least 7 October 2023: 

All three persons are already under threat of assassination by Israel. They do not travel and stay out of the public. Even if arrest warrants are granted against them they are unlikely to be concerned by that.

On the other side of the conflict that may well be a different issue:

On the basis of evidence collected and examined by my Office, I have reasonable grounds to believe that Benjamin NETANYAHU, the Prime Minister of Israel, and Yoav GALLANT, the Minister of Defence of Israel, bear criminal responsibility for  the following war crimes and crimes against humanity committed on the territory of the State of Palestine (in the Gaza strip) from at least 8 October 2023:

  • Starvation of civilians as a method of warfare as a war crime contrary to article 8(2)(b)(xxv) of the Statute;
  • Wilfully causing great suffering, or serious injury to body or health contrary to article 8(2)(a)(iii), or cruel treatment as a war crime contrary to article 8(2)(c)(i);
  • Wilful killing contrary to article 8(2)(a)(i), or Murder as a war crime contrary to article 8(2)(c)(i);
  • Intentionally directing attacks against a civilian population as a war crime contrary to articles 8(2)(b)(i), or 8(2)(e)(i);
  • Extermination and/or murder contrary to articles 7(1)(b) and 7(1)(a), including in the context of deaths caused by starvation, as a crime against humanity;
  • Persecution as a crime against humanity contrary to article 7(1)(h);
  • Other inhumane acts as crimes against humanity contrary to article 7(1)(k).

Should the arrest warrants against Netanyahoo and Galant be granted they will have to end all travel to or through those many countries which are member states of the Rome statute. (The U.S., Israel, Russia and Sudan have signed the Rome statute but did not become member states.)

Member states are under obligation to fulfill arrest warrants should the ICC prosecutor have valid ones. There is also a stigma coming with the warrants that will prevent pro-Zionist politicians from Europe and elsewhere from meeting with Netanyahoo or other involved persons.

The UN recognizes that Palestine is a state, albeit one that is a “non-member observer state”.
But that status was enough to satisfy the ICC that Palestine was a state capable of signing the Rome Statute, which Palestine did in 2015.
Rather settles things as far as the Chief Prosecutor is concerned: only states can sign and ratify the Rome Statute. Palestine has both signed the statute and ratified that signature.
QED: for the purposes of the ICC and for the purposes of the jurisdiction of the court Palestine is a state.

New ambassadors/diplomats/businesses could be rejected/prevented by these countries due to association with a wanted person.

Israelis are trying to obfuscate ICC beyond any normal and a decent norm.
They basically spat on UN by shredding the Charter. Oi, mate, you’re crazy, truly. In UN sit 150+ countries that wouldn’t blink an eye, if Israel is no more.
The only thing that can save a lot of lives and money would be a wise move by Hamas to go voluntarily and quickly to the ICC to argue and tell its side of the story to the world, and broadcast live, if possible. We are still curious as to why the 7th of October happened and what was the aim.
That would damage Israel badly, if not fatally.
The UN can use this momentum to put up pressure on the revision of UN Resolution 181, where it claims to have been given on the condition of a bi-state and infrastructural shared prosperity, within the UN provided and designated grounds. Ignored for too many years, anyway. Israel has never respected the treaty, and by now dragging and bragging about ICC, delaying any progress there, it will lull the ICC into an unimportant ‘old man yelling at the cloud’, showing that nothing really matters anymore. A very head-chopping situation is developing, but I argue that a quick reaction by Hamas towards ICC could be a ninja move against the oppressor.
In any case, it would prevent a silent genocide, as 30-50 dead per day is an acceptable collateral.
So a silent destruction continues, until one side makes the move. Inflicting casualties on IDF is not sufficient, no matter the numbers. Mind you Israelis are not demonstrating against genocide, but for their own hostages back – which is a genocide option – and/or to deal with Hamas better and be more cruel, not forgetting to occupy and clean flatten Gaza for sea front view penthouses.
If you try to de-dollarise, you will be killed, and if you choose not to, you will be sanctioned for thinking about it. The only answer is; the world has the right and the duty to defend itself against everything the West stands for, including Israel, and by any means necessary. I do not see China remaining in the shadows for long, now that Iran is a bit shaken. In the current constellation, the West is a duck on a hot plate, and dancing, so far, very badly.

There seems to be considerable confusion over what an ICC warrant entails. There have been past embarrassments by governments which indicate exactly how much trouble ICC and ICC warrants can be for 3rd party governments but they date back a while because many states have put in place certain ‘protections’ which can force a judge to deal with politicians ahead of the law and that means prosecutors can grab netanyahu the moment he steps outta the zionist entity, if they plan correctly.
The most notorious example occurred in england under thatcher when pinochet the chilean dictator responsible for many murders & tortures was forced to go to england for medical treatment. I think that was a warrant issued by Spain rather than ICC or ICJ, look it up if yer interested. Anyway Pinochet was collared according to the extradition deal between england & spain which england had forced upon Spain so as to catch working class crims who had retired to the sun.

Frankly when the warrants are issued the Hamas leadership can afford to laugh it off as they know any P.A. official is always gonna shoot ’em on sight warrant or no and apart from Palestine where they are protected, no other place they visit is a member of the ICC. That is not the case for the entity’s leaders who have to travel to keep global zionism being a thing. When pols visit other nations on business it is usually on a diplomatic passport which has to be approved in advance by the host nation.
There are very few euro governments prepared to put up with questions about how/why they issued diplomatic immunity to a wanted murderer.
Netanyahu & gallant will be incredibly upset by this as is reflected in the pressure they put on those rethug zionist (or at least donation recipients) to try and prevent this from happening. 1) This is just the first step towards declaring the IDF and perhaps the Likud as a joint criminal enterprise . This means no travel, no business contacts, no Eurovision, no Olympics, no academic exchanges – for essentially all adult citizens of Israel.
Sure – the U.S., England, and most of the EU will ignore such decisions but 87% of the world will respect defining the IDF as a joint criminal enterprise . That’s seems trivial, but to Israelis it’s significant because they are desperate to be seen as a normal country.
2) the Yamashita Standard of Command Responsibility will eventually be coming into play here. The 84 page South African ICJ lawsuit uses language bringing the Yamashita Standard into play. The language used would be very clear to a judge at either the ICJ or ICC. One can expect foreign civilian officials who aided and abetted the genocide to br held to account. A good place to start is the Tokyo Trails, specifically the Comviction of Kōki Hirota.
3) War Crimes have no statute of limitation. All sorts of lower level U.S. gov’t officials who are in their 20s and 30s will need to be careful for many decades hence. For example, a couple of years ago a 90+ German woman was tried and found guilty of war crimes. Her crimes ? She was a 18 year old civilian in a typing pool in 1945.
Conclusion – the Constellation of Forces has changed.

Herod wasn’t Arab; that’s an invention by some recent scholars. He was Idumean, and that identity descends from Edomite, one of the peoples of the Old Testament. But also not far off. ‘Arab’ didn’t exist at the time, except as a denomination of Bedouin. The Arabic language didn’t exist either, but was later born around there.

The Geneva Conventions are mentioned only three times in a thirteen page document. The Hague Regulations are mentioned not at all.
The “Rome Statute” is also only mentioned three times, but the phrase “ICC Statute” (the same thing) is mentioned nine times.
So in terms of the “ICC’s considerations” at this point in time it is leaning far more on the Rome Statute rather than the Geneva Conventions. Which to my mind is right and proper.
But if/when Netanyahu and his sidekicks are led into the dock then I think that will change: the Chief Prosecutor is likely to lean on the Rome Statute for procedural objections, and the Geneva Conventions and the Hague Regulations to prove that Netanyahu is guilty as charged.

In a sane world, what happened 2000 years ago, or 1000 years ago, has no bearing on ownership rights, community rights etc. today. In the real world (where sanity does not prevail in locations like US Congress) some people seriously consider curses recorded in the Bible and plan policies that would avoid such curses. I think this is one of them:
Isaiah 34:5-6:
“For my sword has drunk its fill in the heavens; behold, it descends for judgment upon Edom, upon the people I have devoted to destruction. The Lord has a sword; it is sated with blood; it is gorged with fat, with the blood of lambs and goats, with the fat of the kidneys of rams. For the Lord has a sacrifice in Bozrah, a great slaughter in the land of Edom.”
Yet, quite a bit later, Edom (Idumea in Latin) exists and Herod, one of “his children” becomes the king of Judah (Judea in Latin).
In short, connecting Biblical prophecies that mention the fate of peoples/tribes to reality is tricky. For example, Edom could be both the name of a geographic region and its inhabitants, and if the inhabitant were exteminatated (Jeremiah explaining why), subsequent inhabitants of that region were called Edom again. But they were different people, not the cursed one. But wait: those people were not members of 12 tribes who got the blessing of eternal ownership of Kana’an and were absorbed into Judah in conquest. Subsequently, Judah consists of the descendants of the “original Judah” and “new Edom”, so inheritance of the blessing is not obvious — the curse was definitely not inherited.
There is another aspects in the prophecy, namely that the might of the sword of the Lord comes from animal sacrifices. This is why there are Jews who want to restore animal sacrifices in Jerusalem, once the might of the sword of the Lord is restored, Israel will not need to worry about any enmities among “nations”. Among such Jews there are at least two camps, one insisting on restoring the sacrifices on the spot called Noble Sanctuary by Muslim, above the Western Wall, while another camp plans to restore sacrifices elsewhere. The current “Israel-Gaza” war can be traced to activities of the first camp within the Noble Sanctuary in first days of October last year, activities that were supported by the current government of Israel.
Such are the ways of the only democracy in the Middle East that shares “our Western values”.

The ICC will be dissolved as the BRICS countries, led by South Africa, leave it en masse.
This was the real reason South Africa stuck with the ICC warrant for Putin’s arrest.
Now they’re forcing the ICC to apply their laws equally.
If it fails, it will give South African all the reason needed to tear up the Putin arrest warrant and withdraw from the ICC.

She is admitted to the New York Bar and practiced as a litigation attorney at Sullivan & Cromwell LLP in New York.

For what it is worth the Australian government has refused to condemn the Chief Prosecutor for seeking these arrest warrants.
As far as the Aussie government is concerned the ICC is an independent judiciary that should be allowed to carry out its duties without partisan politicians jumping up and down like demented monkeys.

Am.i correct in thinking that an ICC judgement will only hold in Western circles, but an ICJ judgement can enable intervention even against the West , by any country that belongs to the UN?
If so, when the intolerable situation in Palestine gets near Biden/ Sunak’s elections , USUK nothing to lose by an ICJ verdict of genocide , because it will make Biden and Sunak look capable of compassion and compromise.
If the ICJ refuses to give a judgement of genocide before famine kills 2 million Palestinians, the the ICJ will be no longer fit for purpose and , in my mind , will have to stand trial for deliberately allowing genocide.
There are no limitations in regard to genocide.
