Where is Your Money? - Executive Orders on Iraq and Lebanon

Joshua Landis is Assistant Professor of Middle Eastern Studies at the University of Oklahoma. He mostly works on Syria and Lebanon and writes the blog Syria Comment. Naturally he often travels to Syria too. His opinion on U.S. foreign policy in the Middle East diverges a bit from the currently prevalent one in Washington DC.

There are consequences for committing such a grave crime. In discussing the recent executive order with regard to Lebanon, Landis writes:

In the comment section of the last post, several readers remarked that the wording of this executive order was broad enough and ill-defined enough that it could easily be used to harass journalists and perhaps even bloggers. Some readers suggested this was nonsense, placing their faith in US authorities to respect freedom of speech.

I will recount a personal anecdote that reflects on this. On my return from my last two trips out of the United States, I have been stopped by Homeland Security at the exit ramp of the airplane and retained for four hours or so of interviews and security checks, while notification was sought from authorities in Washington to see if I could be released, causing me to miss my onward flights. My calling cards, contents of my wallet, and personal papers were scanned to add to my computer files. My luggage was also screened for indications of who I had met and what I had done.

Why has my name on the security-threat list? The only conclusion I could come to is that one of my many admirers in Washington had placed me there in order to amuse themselves. When I inquired how I might get my name removed from the list, I was told to have "my lawyer" make inquiries at a Washington address. My hunch is that this would be an exercise in futility even if I were to retain a lawyer. Homeland Security is under no legal obligation to release the reason for which I was replaced on the list. I will have to play the Syrian game of figuring out who I know in the security apparatuses of Washington who might have access to my files and can help to clear up the matter. Security services seem to be surprisingly similar on both sides of the Atlantic.

To get harrassed by homeland-security goons is certainly annoying. But the new executive orders go much further and in effect repeal the 5th amendment:

[O]n August 2 President Bush issued a similar executive order (below) regarding Lebanon. This action authorizes the Treasury to "block the property and interests in property" of "any U.S. persons" (including "a spouse or dependent child") who challenge "the sovereignty of Lebanon" (i.e., support Syria's occupation of Lebanon and its interference in Lebanese politics). In this instance the target can be anyone whose actions are deemed to "pose a significant risk" of undermining Lebanon's democratic processes, violent or not.

Landis will be an excellent test case to give the order a bit of a try. I wonder how he will pay the lawyers he will need to fight this when his property is seized.

The scope of the executive orders on Iraq and on Lebanon is so wide, that these can catch 22 about anyone who utters a word against the Hariri clan that robs Lebanon or gives money to a non-governmental organization in Iraq. Such a person would now "constitute an unusual and extraordinary threat to the national security and foreign policy of the United States."

One can laugh about such statements in these orders. But as Landis' personal experience tells: These guys ain't joking.

Well of course they aren't joking.

This law could have come from the pages of William Shirer's, "The Rise and Fall of the Third Reich" wherein he quotes lengthy legislation or Executive orders stating that such and such is deemed treason against the Fatherland, and then they send out the Goon Class, the police and political police and that's all for you, Hans.

It's comical, if you read it slowly. Often, these kinds of laws were issued after the fact, in order to justify what and who the Gestapo and SS were going after next.

Above all, such directives made it plain to all Germans that the State wasn't kidding. That fear spared the State a great deal of complaint. That fear made good Germans out of most Germans.

And today we will find that good Americans abound. They abound more all the time, the more these kinds of laws are not kicked right back down Mister Bush's throat.

This 29 july order affected the Lebanese, only the Lebanese, and not, potentially US property owners. So, nobody noted, nobody cared, no bloggers screamed.

It is simply an amazing snarl of obfucatory bureaucracy, leaving loopholes for anyone to be guilty of anything, an epitome of Gvmt madness, kafkaesque.

Then, look on the right, takes some study to extract--the title is,

OFAC = office of foreign assets control.

NPWMD = Non proliferation (sanctions) weapons of mass destruction (there are other categories of sanctions)

SDN = specially designated nationals

and look at the list - high schools and labs in Syria, and a whole family called Dokcrat.

And what exactly do these sanctions mean? Difficult to say exactly, as texts tend to contradict each other (e.g. see all the exceptions etc. in the first parag I ref. to.) but see for ex.

During World War I, the Wilson administration took sweeping actions to suppress not only individuals' freedom of action but even their freedom of expression. The 1918 Sedition Act must be read to be believed. Under it, one might be, as some 2,000 persons were, prosecuted for daring to "utter, print, write, or publish any disloyal, profane, scurrilous, or abusive language about the form of government of the United States, or the Constitution of the United States, or the military or naval forces of the United States, or the flag of the United States, or the uniform of the Army or Navy of the United States, or any language intended to bring the form of government of the United States, or the Constitution of the United States, or the military or naval forces of the United States, or the flag of the United States, or the uniform of the Army or Navy of the United Sates into contempt, scorn, contumely, or disrepute." Nor was this all the statute forbade!

When convictions under the Sedition Act were challenged in the courts, the U.S. Supreme Court upheld the statute. To his eternal shame, Justice Oliver Wendell Holmes, Jr., wrote: "When a nation is at war, many things that might be said in time of peace are such a hindrance to its effort that their utterance will not be endured so long as men fight and no Court could regard them as protected by any constitutional right." This decision and others upholding unconstitutional measures undertaken by the Wilson administration might strike the proverbial Man from Mars as odd, because the Constitution itself makes no provision for its own evisceration during wartime or other crisis, yet time and again during national emergencies the justices have allowed the legislative branch and especially the executive branch of government to transcend their constitutionally enumerated powers and to nullify individual rights proclaimed in the Constitution.

Almost as infuriating was an appropriation of $100 million to fund the Committee on Public Information--with no accounting to Congress on how this large sum would be spent. Republicans--and many newspapers--were already viewing Creel's committee as a Wilson publicity machine.

I can't imagine why they didn't pass the above bill (b's reference)as the new sedition act of 2007. I guess there are now more subtle ways to get the message across - by framing the issue through allies, but obviously, the results are the same.

Alexander Cockburn took notice of some possible implications with regards to the anti-war movement (nation subscription only).

Lawrence McGuire, a North Carolinian now teaching in Montpellier, France, organized a meeting of antiwar Americans and various interested French parties there at which I spoke last fall. Since then, we've been discussing off and on the strange fact that while two-thirds of Americans oppose the war in Iraq and want the troops to come home, the antiwar movement is pretty much dead. McGuire had raised the matter of direct solidarity with Iraqis fighting the US presence in Iraq. In other words, support their troops:

"I was reading a recent piece by Phyllis Bennis.... She talked about the 'US military casualties' and the 'Iraqi civilian victims' and it struck me that the grand taboo of the antiwar movement is to show the slightest empathy for the resistance fighters in Iraq. They are never mentioned as people for whom we should show concern, much less admiration.

"But of course, if you are going to sympathize with the US soldiers, who are fighting a war of aggression, then surely you should also sympathize with the soldiers who are fighting for their homeland. Perhaps not until the antiwar movement starts to some degree recognizing that they should include 'the Iraqi resistance fighters' in their pantheon of victims (in addition to US soldiers and Iraqi civilians) will there be the necessary critical mass to have a real movement."

Now, there are many evident reasons why the direct solidarity with resistance fighters visible in the Vietnam antiwar struggle and the Central American anti-intervention movement has not been visible in the movement opposing the Iraq War. The "war on terror" means--and was designed to mean--that any group in the United States with detectable ties to or relations with Iraqi resistance movements would be in line for savage legal reprisals under the terms of the Patriot Act. Another important factor: The contours of the Iraqi resistance are murky and in some aspects unappetizing to secular progressives in the West, or so they virtuously claim. But such cavils were familiar in the 1960s and '80s too, as huge chunks of the solidarity movement found endless reasons to distance themselves from the Vietnamese NLF or the Nicaraguan FSLN. That said, ignorance about the Iraqi resistance is somewhat forgivable. This time there has been no Wilfrid Burchett reporting from behind the lines, and that has had consequences of the kind McGuire sketches out above.

A simple question: Has the end of America's war on Iraq been brought closer by the Democrats' recapture of Congress in November 2006? The answer is that when it comes to the actual war, which has led to the bloody disintegration of Iraqi society, the death of some 3,000 Iraqis a month, the death and mutilation of US soldiers every day, nothing at all has happened since the Democrats rode to victory in November courtesy of popular revulsion against the war. I don't think there is much of an independent left in America today. If there was, then Lawrence McGuire's observation about the lack of solidarity with the Iraqi resistance wouldn't be so obviously on the mark.

The American people are largely against the war, to the huge embarrassment and distress of the Republican and Democratic leadership. So does it matter that there's not much of an antiwar movement? Very much so. It's how the left, down the years, has learned its internationalist ABCs.
